Elan Yaish, a former president of pharmacy Apogee Bio-Pharm LLC, was sentenced to three years in prison and ordered to pay $32 million in restitution for his role in a $32 million health care kickback conspiracy. According to documents filed and statements made in court, Yaish and others agreed to engage in a scheme to pay marketing companies to direct prescriptions for expensive medications to pharmacies. Beneficiaries were contacted by phone and pressured to agree to try expensive medications, such as pain creams, scar creams, eczema creams, and migraine medication. The marketers paid telemedicine companies kickbacks for every beneficiary referred for a prescription, and the telemedicine companies paid doctors to approve the prescriptions, which were directed to pharmacies that included Apogee.
